§382.301 Pre-Employment Testing

No employer shall allow a driver, who the employer intends to hire or use, to perform safety-sensitive functions unless the employer has received a controlled substances test result from the MRO or C/TPA indicating a verified negative test result.

Acknowledgement and Agreement

I/We understand that by enrolling in this consortium, I agree to comply with all requirements in compliance with DOT FMCSA 49 CFR – Part 382 regulations. I acknowledge that failure to send an employee for testing when randomly selected will be counted as a “refusal to test,” which is considered a positive result and requires evaluation by a Substance Abuse Professional (SAP).

I/We further understand that continued membership requires an annual membership fee, in addition to testing and processing charges as applicable.

Note: Clients must comply with DOT random testing rules (§382.305) for selection of drivers for random drug and alcohol testing. Sky Drug Testing administers tests as a C/TPA (Consortium/Third-Party Administrator); Sky Drug Testing is not the employer and is not responsible for employer actions or compliance failures.

Renewal covers consortium membership only. Queries are purchased separately.

Membership Includes

DOT Company Policy, Audit Assistance (DOT/CHP), MIS Report Preparation, Collection Site Assistance, SAP Referrals, FMCSA Clearinghouse Registration, Annual Query & Violation Reporting, Compliance Support.

Program Term

Effective upon signing, remains active for 1 year, automatically renews unless terminated with 30-day notice.

File Retention Requirements

  • Five Years: Alcohol ≥0.02, verified positives, refusals, SAP reports, follow-ups.
  • Three Years: EBT calibration/maintenance records.
  • One Year: Negative/cancelled tests; alcohol <0.02.

Program Administration Responsibilities

Sky Drug Testing provides compliant drug & alcohol testing, training, data management, and reporting services per 49 CFR Part 40 and FMCSA Part 382. Both parties must perform duties per DOT regulations.
