1. Service Description
Sky Drug Test provides comprehensive drug testing and DOT compliance services including but not limited to:
- DOT and non-DOT drug and alcohol testing
- Supervisor training for reasonable suspicion
- FMCSA Drug and Alcohol Clearinghouse setup and management
- Driver file management and qualification services
- Audit support and compliance documentation
- Enrollment packages for fleets of all sizes
All services are provided in accordance with DOT regulations, FMCSA requirements, and industry best practices to ensure road safety and compliance in the transportation industry.
2. Client Responsibilities
As a client of Sky Drug Test, you agree to:
- Provide accurate and complete information for all drug testing and compliance services
- Ensure all drivers are properly enrolled in required testing programs
- Maintain confidentiality of drug test results and driver information
- Comply with all applicable DOT regulations and federal requirements
- Notify us immediately of any changes in driver status or company information
- Pay all fees and charges in accordance with agreed-upon terms
3. Privacy and Confidentiality
We are committed to protecting the privacy and confidentiality of all client information. All drug test results, driver qualification files, and compliance documentation are handled with strict confidentiality in accordance with DOT Part 40 and Part 382 regulations. We maintain 98% accuracy in driver file management and ensure 100% Clearinghouse compliance for all enrolled CDL drivers.
Client information will only be disclosed as required by law, including reporting to the FMCSA Drug and Alcohol Clearinghouse, sharing with certified laboratories and Medical Review Officers, or as necessary for audit support and compliance documentation.
4. Payment Terms
Payment terms vary by service package and are outlined in individual service agreements. Generally:
- Owner-Operator packages start at $195
- Small Fleet packages (1-4 drivers) start at $495
- Large Fleet packages are customized based on fleet size and needs
- Payment is due according to the terms specified in your service agreement
- Late payments may result in service suspension
5. Service Availability
Our services are available during regular business hours (Monday through Friday, 9:00 AM to 5:30 PM) with 24/7 support for post-accident and urgent testing needs. We maintain a nationwide network of collection sites to ensure convenient access to testing services.
While we strive to provide continuous service availability, we cannot guarantee uninterrupted access due to factors beyond our control, including but not limited to:
- Internet connectivity issues
- Third-party service provider outages
- Regulatory changes affecting service delivery
- Force majeure events
6. Intellectual Property Rights
All content, materials, and intellectual property on this website, including but not limited to:
- Company name, logo, and all related names, logos, product and service names, and designs
- Training materials, policies, and compliance documentation
- Software, databases, and proprietary systems
- Copyrighted materials and trade secrets
Are owned by Sky Drug Test and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws. No right, title, or interest in any content is transferred to clients, and all rights not expressly granted are reserved by Sky Drug Test.
7. Limitation of Liability
Sky Drug Test's liability is limited to the maximum extent permitted by law. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from the use of our services or website.
Our total liability for any claims arising from our services shall not exceed the amount paid by the client for the specific service giving rise to the claim.
8. Termination
Either party may terminate service agreements with 30 days written notice. Sky Drug Test reserves the right to immediately terminate services in cases of:
- Non-payment of fees
- Violation of these terms and conditions
- Non-compliance with DOT regulations
- Misrepresentation of information
9. Changes to Terms
We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website. Continued use of our services after changes constitutes acceptance of the modified terms. We recommend reviewing these terms periodically for updates.
