Random Drug Testing Explained

The random drug testing process involves selecting employees for testing without prior
notice. This helps to deter substance abuse. Under both FMCSA and DOT guidelines,
employers are required to conduct random drug and alcohol tests for safety-sensitive
employees, such as commercial vehicle operators.
Random Drug Testing Regulations
The FMCSA and DOT regulations set forth strict standards for random drug testing
programs to ensure that transportation professionals adhere to safety standards. These
rules mandate:
- Random testing pools: Using a computer-generated process, every driver has an equal chance of being selected.
- Minimum annual rates: The FMCSA requires at least 50% of active drivers in safety-sensitive positions to be randomly tested for drugs annually. At least 10% of active drivers are required to be tested for alcohol.
- For drug testing: Random drug testing can occur any time on duty. Following the standard DOT 5-panel, the drugs screened are Marijuana (THC), Cocaine, Amphetamines (including methamphetamine), Opioids, and PCP.
- For alcohol testing: Random alcohol testing may be conducted just before, during, or just after performing safety-sensitive work. Once notified, the driver must proceed immediately to the designated collection site.
- If there is a positive result or a test refusal: The safety-sensitive employee is immediately removed from duty and the violation is reported to the FMCSA Drug & Alcohol Clearinghouse. The driver's CDL may also be downgraded until the Return-to-Duty process is successfully completed.

Alcohol testing is conducted separately, usually with a breathalyzer.
